Terms and Conditions

1. Agreement and Acceptance of Terms

1.1 Acceptance

By downloading, installing, accessing, or using the HotApp Application ("the App"), you ("User") agree to be bound by these Terms and Conditions ("T&C"), our Privacy Policy, and our Acceptable Use Policy (if separate). If you do not agree to these T&C, you may not use the App.

1.2 Eligibility

Use of the App is void where prohibited. By using the App, you represent and warrant that you are at least 18 years of age or accessing the App under the supervision of a parent or legal guardian.

2. Description of Service

The HotApp Application is an integrated hotel digital service platform designed to enhance customer experience and operational efficiency by facilitating:

  • Digital access to existing Hotel Reservation Data.
  • Online Check-in and Online Check-out functionality.
  • The ability to digitally Request Hotel Services (e.g., room service, housekeeping, maintenance). Request Hotel Services (e.g., room service, housekeeping, maintenance).
  • Data integration with CRM for personalized marketing and service offers.

3. Account Registration and Security

3.1 Data Sync and Reservation Linkage (Relevant to Point 1)

To use the App's core features (check-in, service request), you must either log in using your pre-existing reservation details or create a new account. You acknowledge that linking your account relies on the accuracy of the data provided by the relevant hotel property.

3.2 Accuracy of Information

You agree to provide accurate, current, and complete information during registration and use. You are responsible for maintaining the accuracy of your account information.

3.3 Account Responsibility

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

4. Specific Service Usage Terms (Relevant to Points 2, 3, and 4)

4.1 Online Check-in and Check-out

The App facilitates the requestfor online check-in/out. Final approval and fulfillment of check-in/out, including key issuance, legal documentation requirements, and settling final payments, are the sole responsibility of the specific Hotel Property.

4.2 Hotel Service Requests

  • Fulfillment: All service requests made via the App (e.g., room service, towel requests) are directed to and fulfilled entirely by the Hotel Property staff. The App is merely the communication medium.
  • Charges: You acknowledge that services requested through the App may incur charges, which will be added to your hotel bill and are governed by the Hotel Property's payment policies.
  • Limitations: We do not guarantee the speed or fulfillment of any request, as these are dependent on the Hotel Property's staffing and operational status.

4.3 Third-Party Links and Booking

The App may link to third-party services (e.g., local attractions, external booking tools). We are not responsible for the content, accuracy, or availability of these third-party services.

5. Data Privacy and Marketing (Relevant to Point 5)

5.1 Privacy Policy

Your submission of information through the App is governed by our Privacy Policy. Please review the Privacy Policy, which also governs the CRM integration, to understand our practices regarding the collection, use, and sharing of your data.

5.2 CRM and Marketing

You explicitly agree and consent that your usage data, contact information, and reservation history will be shared with our Customer Relationship Management (CRM) systems to:

  • Analyze your preferences and usage patterns.
  • Personalize your service experience during your stay.
  • Receive targeted promotions, marketing materials, and deals from HotApp and associated Hotel Properties in the future. You may opt-out of marketing communications as detailed in the Privacy Policy.

6. Intellectual Property Rights

The App, its original content, features, and functionality (including all software, text, images, and design) are and will remain the exclusive property of Web Connection Co.,Ltd. and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the App solely for your personal, non-commercial use as a hotel guest.

7. Disclaimers and Limitation of Liability

7.1 "As Is" Basis

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the App's uninterrupted availability, accuracy of data sync, or error-free operation.

7.2 No Responsibility for Hotel Actions

We are not responsible for the direct actions, omissions, or negligence of the Hotel Property staff or management. Any issues related to the quality of service, fulfillment of requests, room condition, or billing discrepancies must be resolved directly with the specific Hotel Property.

7.3 Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Web Connection Co.,Ltd. be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; or (ii) any conduct or content of any third party or Hotel Property.

8. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these T&C or our Acceptable Use Policy.

9. Governing Law

This Agreement is governed by the laws of Thailand, and each party irrevocably submits to the non-exclusive jurisdiction of the courts of Thailand.
